⚠️ Important Notice: Please read this document carefully before registering. By completing your registration, you are confirming that you have read, understood, and accepted all terms contained in this Legal, Indemnification & Waiver document.

1. Assumption of Risk

I, the participant, understand and acknowledge that participation in the Proposed Hekima University Molo Marathon 2026 ("the Event") involves physical exertion and inherent risks, including but not limited to:

  • Physical injury, illness, or exhaustion from running
  • Adverse weather conditions at altitude (Molo is situated at approximately 2,380–2,460m above sea level)
  • Road hazards, uneven terrain, and obstacles along the race route
  • Health emergencies, including cardiac events or heat exhaustion
  • Risks associated with large public gatherings

I voluntarily assume all risks associated with my participation. I confirm that I am physically fit and have undertaken appropriate medical screening and training in preparation for my chosen race category.

2. Medical Fitness Declaration

By registering, I declare that:

  • I am in good general health and physically capable of completing my chosen race distance.
  • I have consulted or will consult a qualified medical professional if I have any pre-existing conditions, including but not limited to cardiac conditions, diabetes, asthma, high blood pressure, or joint injuries.
  • If I am aged 40 or above, I have obtained medical clearance to participate in strenuous running activity.
  • I will not participate if I feel unwell on race day and will not withhold any relevant medical information from event medical personnel if I require assistance.

3. Indemnification & Waiver of Liability

"I, the participant, hereby for myself, my heirs, executors, administrators, legal representatives, and assigns, waive and release any and all rights, claims, and causes of action for damages, losses, or injury of any kind (including death) that I may have against The Proposed Hekima University, Global Link Marketing, Athletics Kenya (AK), KPRA, Kenya Red Cross, Jesuit Eastern Africa, Nakuru County Government, and all respective directors, officers, employees, agents, volunteers, sponsors, partners, and successors — arising from or in connection with my participation in the Proposed Hekima University Molo Marathon 2026."

This release covers, but is not limited to:

  • Personal injury, illness, or death arising from participation in the Event
  • Loss or damage to personal property during the Event
  • Actions or omissions of event officials, volunteers, or other participants
  • First aid or medical treatment administered during or after the Event
  • Transportation or logistics to or from the event venue

4. Consent to Emergency Medical Treatment

I authorise and consent to the provision of first aid and emergency medical treatment by event medical personnel and any qualified medical professional, if I am incapacitated or otherwise unable to communicate during the Event. I understand that any costs associated with emergency medical services beyond basic first aid may be my responsibility or that of my designated emergency contact and/or medical insurance.

5. Image & Media Consent

I grant the Organiser, its partners, and sponsors a perpetual, royalty-free licence to use photographs, videos, audio recordings, and other media containing my likeness taken during the Event for promotional, marketing, editorial, and commercial purposes across all media, including digital platforms, print, broadcast, and social media.

I waive any right to compensation, review, or approval of such use.

6. Data Protection & Privacy

I consent to the collection, storage, and processing of my personal information (name, contact details, health data, emergency contacts) solely for the purposes of administering the Event, communicating with me regarding the Event, and ensuring participant safety. My data will not be sold to third parties. In registering, I acknowledge the Organiser's privacy obligations under applicable Kenyan data protection law.

7. Race Rules Compliance

I agree to abide by the official race rules, the instructions of marshals and officials, and all applicable laws of Kenya during the Event. I understand that failure to comply may result in disqualification, removal from the event, or, in cases of serious misconduct, legal action.

8. Acknowledgement of Fundraising Purpose

I understand that all registration fees and sponsorship proceeds from this Event are directed towards the construction of the Proposed Hekima University Administration Block and student scholarship programmes. I support this mission and participate willingly in furtherance of this cause.

9. Binding Agreement

By submitting my registration form (online or in person), I confirm that I have read, understood, and voluntarily accept all the terms set out in this Legal, Indemnification & Waiver document and in the Event's Terms & Conditions. I confirm that I am 18 years of age or older, or that a parent/guardian has completed this registration on my behalf and accepts these terms on my behalf.

This agreement is legally binding and shall be governed by the laws of the Republic of Kenya.
